دور التحكيم في تنفيذ حرية الأطراف في اختيار القانون الواجب التطبيق

إن اللجوء إلى التحكيم كوسيلة لفض الخصومات يرجع إلى الحرية التي يتمتع بها أطراف الخصومة التحكيمية في اختيار القانون الواجب التطبيق على إجراءات التحكيم، بالإضافة إلى حرية اختيار هيئة التحكيم والقانون الذي يحكم النزاع. لا يعني اختيار الأطراف لقانون معين أنه يجب أن يكون قانون دولة معينة؛ بل من الممكن للأطراف أن يختاروا قوانين متعددة من دول مختلفة بشكل مجزأ لحسم النزاع، فضلاً عن اختيار قواعد أخرى لحسم النزاع لا يشترط أن تكون ذات مصدر وطني. في حالة غياب اتفاق الأطراف الصريح أو الضمني، يمكن للمحكم أن يختار القانون الأنسب للنزاع بناءً على الصلة والرابطة القوية بين ذلك القانون وموضوع النزاع. عند تحديد القانون الأنسب، يجب على المحكم مراعاة شروط العقد والعرف التجاري السائد في نوع النشاط لتحديد القانون الملائم. كما أن المحكم يمكنه ممارسة سلطته وفق القواعد العدل والإنصاف شريطة اختيار الأطراف لهذا الأسلوب، مما يعفي المحكم من مهمة تحديد القانون الواجب التطبيق على النزاع.
