نشأة وتطور الوظيفة الاستشارية لمحكمة العدل الدولية

إن الوظيفة الاستشارية لم تكن وليدة اللحظة، وإنما هي وظيفة عرفتها نظم قانونية دولية عديدة سبقت في ظهورها النظام القانوني الدولي الحالي، وبقيام عصبة الأمم وإنشاء محكمة العدل الدولية الدائمة، تطورت الوظيفة الاستشارية لمحكمة العدل الدولية تطوراً ملحوظاً مما حدا بالبعض إلى القول بأن الوظيفة الاستشارية لمحكمة العدل الدولية قد نشأت أصلاً مع إنشاء عصبة الأمم ومحكمة العدل الدولية الدائمة.
امتدت الوظيفة الاستشارية لتشمل بعض المنظمات الأوروبية مثل محكمة العدل الأوروبية والمحكمة الأوروبية لحقوق الإنسان، وكذلك الأمر لم تقتصر هذه الوظيفة على المنظمات الأوروبية فقط إنما امتدت أيضاً لتشمل بعض المنظمات الدولية والإقليمية الأخرى، مثل المحكمة الأمريكية لحقوق الإنسان، واللجنة الأفريقية لحقوق الإنسان والشعوب، وكذلك محكمة العدل الإسلامية الدولية، وهذا يمثل دليلاً على أهمية هذه الوظيفة على المستوى الدولي والإقليمي.
