الملخص

تناولت هذه الدراسة المفاهيم القانونية لهذه الشركات العابرة للحدود، وكذلك الإشكاليات القانونية المتعلقة بتحديد القانون الواجب التطبيق عليها من حيث التأسيس, والمنازعات الناجمة عن نشاطها, وقد هدفت هذه الدراسة إلى الوقوف على القانون الواجب التطبيق؛ وذلك تجنبًا للتعقيدات القضائية وتضارب القوانين في شأنها, وتوصلت لعدة نتائج, أهمها: أن النصوص التشريعية المتعلقة بالنشاط الالكتروني غير كافية لمواكبة هذا النوع من الشركات، وأن هناك حاجة ملحة لتطويرها, واختتمناها بجملة من التوصيات، أبرزها: تطوير قانون المعاملات الالكترونية ليتضمن حلولاً مناسبة لا سيما فيما يتعلق بالقانون الواجب التطبيق, وتعزيز التعاون بين الدول لصياغة قواعد موحدة تحدد هذا القانون.
