Sharia controls for the use of artificial intelligence
Abstract
It is evident that the world today is witnessing rapid developments in technology and information systems, particularly in the field of artificial intelligence, which has penetrated various aspects of our lives. AI applications play a pivotal role in numerous fields, offering vast opportunities for continuous improvement and development. However, this widespread expansion necessitates the regulated use of AI tools and the monitoring of their performance at all stages—design, development, and implementation—in light of Islamic law.
The primary objective of AI systems is to simulate human intelligence through advanced software that can be utilized in solving non-routine problems or addressing complex issues that require human effort and consideration of multiple alternatives. This study aims to define the concept of al-ḍābiṭ al-fiqhī (jurisprudential principle), clarify the notion of AI tools, and examine the Islamic ruling on their use, while deriving jurisprudential guidelines for their application.
The significance of this study lies in addressing this technological revolution that has entered all domains of life, linking Islamic jurisprudence to contemporary reality, and highlighting the comprehensiveness of Islamic law in adapting to the rapid developments in all aspects of life. It also seeks to demonstrate the timeless applicability of Sharia and to propose legitimate jurisprudential solutions to challenges arising from technological advancements.
Guided by these objectives, the study adopts the descriptive and analytical method, following standard procedures in Sharia research, such as referencing Quranic verses to their chapters, verifying and grading Hadiths from authoritative sources, and consulting primary references.
This leads to the main research question: What are the jurisprudential guidelines for the use of AI tools? The question is addressed through two main sections: the first defines the conceptual framework of the research terms, namely the jurisprudential principle and artificial intelligence; the second explores the jurisprudential guidelines for using AI tools and presents examples of AI applications in light of the objectives of Islamic law (Maqāṣid al-Sharī‘ah).
