Abstract

The book explores the author's approach to addressing fiqh issues, focusing on explaining the rulings contained in the text of "Tuhfat al-Hukkam" in a simplified and accessible manner for students of knowledge. Al-Tawzari demonstrates his strong reliance on the well-known Maliki school of thought, known as the "opinion" (qawḥ) that has been widely adopted by the school's imams. The book focuses on clarifying fiqh issues related to judgments, testimonies, oaths, and mortgages, as well as the rulings on sales, marriage, and other matters. The author relies on citing the various fiqh opinions on the matter, then supports his chosen opinion with evidence from the Qur'an, the Sunnah, and established principles of the Maliki school, such as analogy (qiyas), istihsan (jurisprudence), and masalih al-mursala (public interest). The book highlights al-Tawzari's ability to combine linguistic explanation of the text with clarification of sharia rulings, while focusing on established practice within the Maliki school, making it an important reference in Maliki jurisprudence.
