Constructive seizure in Islamic jurisprudence: The treatment of personal belongings in Libya as a case study

Abstract

This research addresses the origin of the issue of constructive possession and its contemporary applications in the Libyan banking sector. The research begins by stating the obligation of the person responsible to learn the rules of financial transactions before engaging in them in order to avoid falling into what is forbidden by Sharia. Constructive possession has been defined as treating the sold item, which cannot be physically possessed, as if it were actually taken for a legitimate reason, so that the effects of actual possession of enabling and relinquishing it are established. The study confirmed that constructive possession has a fixed Sharia basis, and it is a means to remove hardship and difficulty and to meet people’s renewed needs in line with the rule of changing rulings with changing customs. These concepts were applied to the “personal purposes” transaction (dollar card) launched by the Central Bank of Libya.
