Abstract

The idea of ​​the research talks about responsibility in general and takes into account the historical roots in the mixing of punishment with compensation and then the division of responsibility... Now back to the idea of ​​punitive compensation, which has its effect on ancient civilizations. The controversy surrounding its existence or non-existence as an idea in French law extends its impact to the laws affected by Latin jurisprudence, including Libyan law... Hence this study came to define the concept of punitive compensation the historical roots of the idea, and the appropriateness of its adoption in Libyan law, or research It contains applications for this idea.
