تتناول هذه الدراسة المسؤولية المدنية الناشئة عن الأخطاء الطبية في إطار القانون الليبي. حيث تستعرض دراستنا هذه حول ماهية الضرر الطبي وآليات إثبات المسئولية الطبية، وأنواع الأضرار التي يمكن أن تلحق بالمرضى، وآليات التعويض. كما تتناول الدراسة أبرز التحديات التي تواجه تطبيق أحكام المسؤولية الطبية في ليبيا، واقتراحات لتطوير التشريعات والقضاء في هذا المجال.
عليه سيتم تناول هذا البحث من خلال مطلبين رئيسين المطلب الأول يتناول ماهية الضرر المادي والأدبي والمطلب الثاني يتناول آليات الاثبات عن المسؤولية المترتبة عن هذا الخطأ.
