Habeas corpus with prior confession of offence "Read in French legislation"
Abstract
This research addresses the system of habeas corpus based on prior confession of crime; The most important modern mechanisms for solving the almost paralysing criminal justice crisis, adopted by French legislation in response to the requirements of contemporary criminal thought, were designed to build a clear vision of the system's comparative legal organization; To measure its success in fulfilling its mandated and expected role, in order to monitor the effectiveness of its application in domestic legislation, also within the framework of the analytical and comparative descriptive approach; The study found that this evolving and growing system of legislation represents a new phase and probably not the latter in the context of consensual justice systems; However, it is not necessarily an ideal solution or a model of what should be; However, it can be relied upon to overcome traditional justice problems; If its disadvantages are overcome by the proposals we have made in the corners of this research to ensure its proper application.
