أن الخطأ الطبي المُوجب للمسؤولية الجنائية في القانون الليبي يتحقق عندما يرتكب الطبيب فعلًا أو يتسبب في ضرر للمريض نتيجة إهماله أو عدم اتباعه للمعايير المهنية أو القانونية ، و يشمل ذلك الإهمال، التهور، عدم الكفاءة، ومخالفة القوانين الطبية إذا أدى هذا الخطأ إلى ضرر جسدي أو وفاة، يتحمل الطبيب المسؤولية الجنائية، مع الأخذ في الاعتبار التوازن بين محاسبته وبين تشجيع التطور العلمي في الطب.
