إدارة أموال الوقف في القانون الليبي

إن الأموال الموقوفة تحتاج إلى من يقوم بحفظها ورعايتها وإدارة شؤونها من حيث الاستغلال، سواء تمثل ذلك في البناء أو الإيجار أو توزيع الريع على مستحقيها وحمايتها من الغير ودفع الاعتداء الحاصل عليها والمطالبة بجميع حقوقها في أي يد كانت وحيثما وجدت، وهذا كله لكي يستمر الوقف للغاية التي أنشأ من أجلها، ومن ثم لا يتصور أن يوجد وقف من غير ولاية، ويسمى القائم على إقامة الوقف بالناظر أو بالقيم أو المتولي.
ويهدف هذا البحث إلى التعرف والكشف عن إدارة أموال الوقف من خلال النصوص القانونية في القانون الليبي ومقارنتها بغيرها أحياناً من قواعد القانون المصري أو قواعد الفقه الإسلامي لكي يتسنى لنا الكشف عن المعوقات العملية لهذه النصوص والسعي في إيجاد نصوص عملية سليمة تحفظ أموال الوقف وتبعد عنها الخطر وتحقق التنمية المستدامة وعليه فقد قمت بتناول مفهوم إدارة الوقف في المبحث الأول ولمن تثبت له الولاية في النظر على الوقف ثم إلى دراسة عزل الناظر ومحاسبته، وأما المبحث الثاني فقد خصص لتناول وظيفة الناظر، سواء تمثلت في الإيجار أو الاستدانة أو بناء وعمارة الوقف ثم جاءت الخاتمة مستهدية ببعض النتائج والتوصيات للحفاظ على أموال الوقف من العبث والضياع.
