Artificial insemination provisions in Libyan law

Abstract

This study addresses the subject of artificial insemination due to its significance in contemporary jurisprudential debates, as it represents a solution to the challenges of pregnancy and childbirth faced by couples. The researcher employed a descriptive-analytical methodology to examine the Libyan legal texts related to artificial insemination, dividing the study into two main sections: the first deals with the concept and types of artificial insemination, while the second focuses on the stance of the Libyan legislator towards this technique.

The importance of the study lies in highlighting the medical, legal, religious, and ethical aspects of artificial insemination, thereby contributing to the development of Libyan laws to ensure their conformity with the religious and moral values of society. The study concluded on the necessity for legislative intervention by the Libyan legislator to clarify the ambiguities in the current regulation of artificial insemination, particularly with regard to issues such as surrogate motherhood and sperm freezing.

This research provides the reader with a comprehensive understanding of the legal and religious dimensions related to artificial insemination and the means to regulate these provisions in a manner that balances individual rights with societal values.
